Who is Eligible for Military Parole in Place?

One such program is Military Parole in Place (PIP). What is Military Parole in Place?

Military Parole in Place, commonly referred to as PIP, is a form of discretionary relief provided by the U.S. Citizenship and Immigration Services (USCIS). It allows certain undocumented family members of U.S. military personnel, veterans, or reservists to remain in the United States for a specified period, even if they entered the country without proper authorization.

The primary purpose of PIP is to prevent the disruption of military service caused by the potential deportation of a family member. For military personnel focused on serving the nation, knowing their loved ones are safe can make all the difference.

Benefits of Military Parole in Place

The benefits of PIP can be significant for eligible individuals. If approved, beneficiaries of PIP gain the following advantages:

  • Protection from Unlawful Presence: Recipients of PIP do not accrue unlawful presence during the designated parole period.
  • Ability to Apply for Work Authorization: Eligible individuals can request a work permit, allowing them to contribute financially and support their family.
  • Pathway to Further Immigration Benefits: PIP can be a gateway to applying for certain immigration statuses, such as a Green Card, for those who meet additional requirements. Importantly, it provides the lawful entry necessary for adjustment of status.

However, it must be noted that while PIP offers temporary protection and benefits, it does not directly grant an immigration status or resolve all immigration issues.

Who is Eligible for Military Parole in Place?

Eligibility for PIP is determined on a case-by-case basis and is limited to qualifying family members of military service members. To be eligible, individuals must:

Have a Qualifying Family Relationship:

  • Be the spouse, widow(er), parent, son, or daughter of:
    • An active-duty member of the U.S. Armed Forces.
    • An individual in the Selected Reserve of the Ready Reserve.
    • A military veteran (living or deceased) who served in active-duty or the Selected Reserve of the Ready Reserve and received an honorable or other than dishonorable discharge.

Provide Required Documentation:

Applicants must demonstrate eligibility by submitting evidence such as:

  • Proof of the family relationship with the service member (e.g., marriage certificate, birth certificate).
  • Documentation of the service member’s active duty, reserve status, or veteran status, such as military service records or discharge papers (DD Form 214).

How to Request Military Parole in Place

To apply for PIP, individuals must submit Form I-131, Application for Travel Document, to their local USCIS office. Importantly, this application process does not require any filing fee. Alongside the form, applicants should include all supporting documentation and a detailed explanation of their eligibility.
