The Visa Waiver Program allows qualifying foreign nationals from designated countries to enter the U.S. for up to 90 days without obtaining a visa. Most people admitted under VWP are not eligible to adjust their status (during or after the 90-day period), but there are important exceptions. Even when you are eligible for adjustment, it can be a complex process. That’s where we come in. If you were admitted to the U.S. under the VWP and have immediate relatives who are U.S. citizens, you may be eligible to adjust your status and stay beyond the 90-day period. Even those who have overstayed the 90 days may still be eligible for adjustment of status as long as they meet certain conditions.
Although the law generally prohibits VWP participants from adjusting their status, there is an exception for immediate relatives of U.S. citizens. USCIS field offices have been directed to adjudicate the adjustment of status cases filed by immediate relatives of U.S. citizens admitted under the VWP. This includes cases where Form I-485 was filed after the 90-day period of admission.
