An Overview of DHS Public Charge Final Rule

On September 9, 2022 DHS announced the final rule for the public charge ground of inadmissibility.  The new rule provides guidance to USCIS when evaluating whether a person is likely to become a public charge and clarifies that it doesn’t apply to nonimmigrants. This final rule will go into effect on December 23, 2022 and applies only to lawful permanent resident applications that are submitted or postmarked on or after December 23, 2022. Read more below.
